The Landlord is Responsible

The primary responsibility of landlords is to provide tenants with access to a habitable rental unit, which includes providing a toilet, running hot and cold water and a tub or shower. This requires keeping up with regular maintenance and ensuring that the unit is free from hazards, such as leaky pipes. The landlord is also responsible for making any necessary repairs to keep the apartment livable.

Despite a landlord’s best efforts, there will be times that water damage occurs in a rental due to a tenant’s actions or negligence. This can include things like a tenant leaving the refrigerator open and causing water to leak through the ceiling or flushing items down the toilet that are not food waste. If a problem is a result of a tenant’s negligence, they may be held responsible for the cost to repair it or replace the damaged belongings.

When there is a water leak or flood, the first step is always to turn off the water supply. Most appliances and fixtures have shut-off valves that can be easily turned off in the event of a plumbing emergency.
